Introduction

This privacy policy sets out how Disc Brakes Australia Pty Ltd (ACN  003 543 995) (Trading As DBA) handles your personal information.

Personal information is any information about you where your identity is apparent, or can reasonably be ascertained, from the information.

DBA’s privacy policy is based on openness. Where we request information from you, we will generally state the purpose(s) for its use and to whom it may be disclosed.

Our website may contain links to third party websites.  We are not responsible for the privacy policies of any third party websites.  We recommend that you review the privacy policy of each website you visit.

Collection of Personal Information

The amount of personal information we collect about you depends on how you interact with us.  We will collect personal information from you if you:

  • contact us through our website using an on-line form;
  • make a product or service enquiry;
  • order a product;
  • send a product in for service / repair
  • make a product complaint or warranty enquiry;
  • complete an application or enter into an agreement;
  • receive a visit from one of our representatives;
  • subscribe to one of our mailing lists;
  • correspond with us, including by email;
  • call our Customer Service line;
  • enter a promotion or competition;
  • contact us via any of our social media platforms.

The type of personal information you may provide to us includes your name, position description, address, email address, business type, telephone, age group, mobile phone number, facsimile number, credit card particulars and bank details.

By providing your personal information to DBA in this way, including by completing on-line forms and email, you agree to the collection of that information in accordance with this privacy policy.

We collect personal information from you for a number of reasons, including to:

  • sell and deliver our products and services to you;
  • respond to your questions or requests for information;
  • manage warranty claims and provide after sales service;
  • improve our service;
  • assist us in forecasting future demand for our products and services;
  • send you direct marketing material electronically or by post;
  • analyse our website usage;
  • enhance the content of our website and our social media platforms;
  • keep a record of our dealings with each other; and
  • comply with legal obligations.

Credit Reporting Information

DBA also collects financial and trading information from customers in order to establish and manage business and customer relationships. This information is securely held for internal accounting and administration purposes associated with the provision of products and services (including the extension of commercial credit) to customers and in order to enhance our business relationship and level of service.

Collection of commercial credit information is undertaken only with your consent. To complete an application to open an account or extend commercial credit we may ask you to provide: ABN / CAN numbers, business names, business structure, address and contact details, bank details, trading history and commercial trade references.

DBA may disclose this information to a credit reporting body or trade referees nominated by you, and receive commercial credit information about you. This credit information will only be used to assess your credit worthiness. It will not be used for the purposes of pre-screening of direct marketing by a credit provider, and will not be intentionally disclosed to entities outside Australia unless advised.

To the extent that the customer is an unincorporated entity, this is personal information covered by this policy. Information about corporate customers, which is about an identifiable person, is also personal information covered by this policy. DBA does not have a practice of collecting or holding consumer credit information covered by the Credit Reporting Privacy Code.

Enquiries for access to or correction of commercial credit information or credit eligibility information, or complaints about the failure of DBA to comply with the Privacy Act 1988 (Cth) or the Credit Reporting Privacy Code (if this binds DBA), can be made as set out below under “Access and Correction” and “Queries and Complaints”.

Social Media

To customise your user experience on our website we may provide you with the opportunity to connect, access and/or interact with third-party social networking services, such as LinkedIn, Facebook, You Tube and Instagram.  If you connect to these third-party social networking services, including to participate in one of our promotional campaigns, you are authorising DBA to access and use certain information from your social network profile. By using social plug-ins (such as the Like button) information about your activities on Facebook—including information about your device, websites you visit, purchases you make, the ads you see, and how you use their services— are logged into and available to Facebook. Facebook provides you with the ability to access, rectify, port and erase your data. Disclosure to Third Parties

DBA recognises the trust you place in us when you give us your personal information and so will not give your personal information to third parties unless:

  • you have given us your consent to do so;
  • it is necessary for us to do so to fulfil the primary purpose(s) for which we collected your personal information;
  • you would reasonably expect us to disclose it for a related purpose; or
  • we are required to do so by law.

The third parties we will typically share your personal information with include companies in our own corporate group (including in New Zealand), your authorised representatives and service providers which we use to conduct our business, functions and activities. These organisations may be involved or conduct:

  • mailing, shipping or courier operations;
  • information technology services;
  • legal, auditing, accountancy or other professional services;

  • promotions and competitions;
  • repair, installation or maintenance services;
  • insurance services;

If you contact us about orders outside Australia, we may refer your enquiry to our authorised international distributors to respond to your query or effect the transaction.  We will take reasonable steps to ensure that your personal information is disclosed to such third parties in accordance with this privacy policy and on a confidential basis.

Cross Border Disclosure

Personal information may be disclosed to companies within our own corporate group, or our distributors, operating internationally. If you engage with our distributors in Europe or the United Kingdom their collection of any personal information will be described in the Privacy Policies on their websites. If we disclose personal information outside Australia, we will only do so in compliance with all applicable Australian data protection and privacy laws and if we reasonably believe that the information will remain subject to principles for fair handling of the information which are substantially similar to the applicable Australian privacy laws.

Website data and cookies

When you visit our website, we may collect your server address, domain name and information regarding the pages which you visit and links that you click on.  This information is used by us for statistical and website development purposes.. Our website uses web analytics services, sch as Google Analytics which uses ‘cookies’ to analyse how visitors to the website use the site.

A cookie is a piece of information that our web server may transfer to your hard drive for record-keeping purposes. The cookie is stored on your computer, and can facilitate your ongoing access to and use of our website.  Information which may be collected includes your IP address, Internet Service Provider, domain name, data services provider, device ID and type as well as your usage information and online behaviour. Some cookies simply enable certain functions of the website, and others track user experiences, store your preferences, build anonymous statistical data about how our website is performing, and power the personalisation of website content to you. Security

  • keep your personal information secure in a combination of secure computer storage, hard copy files and other access-controlled records; and
  • ensure your personal information is protected from misuse, interference, loss and from unauthorised access, modification or disclosure.

We will endeavour to destroy or de-identify your personal information when it is no longer needed for the purpose for which it was provided, unless a legal exception applies.

Access and Correction

We will take all reasonable steps to ensure that your personal information which we collect, use or disclose is relevant, accurate, complete and up-to-date. We appreciate you assisting us by letting us know if your personal information has changed.

We at Disc Brakes Australia Pty Ltd (Trading As DBA) (“DBA,” “we,” “us,” or “our”) have created this privacy policy (this “Privacy Policy”) because we know that you care about how information you provide to us is used and shared.  This Privacy Policy relates to the information collection and use practices of DBA in connection with its website located at www.dba.com.au (the “Site”).

Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use.

The Information We Collect and/or Receive

In the course of operating the Site, and/or interacting with you, DBA will collect (and/or receive) the following types of information.

1. Contact Information

When you contact us through the “Contact Us” feature on the Site, make a product or service inquiry, order a product, make a product complaint or a warranty inquiry, or sign up to receive our newsletter or be on our mailing list, you will be asked to provide certain information, including but not limited to, name, e-mail address, phone number and delivery address (collectively, “Contact Information”). The Contact Information is used to provide the requested service or information and to contact you for purposes of direct marketing of our current and future services.

2. Order Information

When you order products through our Site, we will ask you to provide certain additional information, including but not limited to, the products you would like to order, and the shipping information (collectively, the “Order Information”).

3. Billing Information

In order to purchase products, you will be required to provide certain additional information which may include a credit card number, expiration date, billing zip code, activation code, bank information, and similar information (“Billing Information”). Such Billing Information will be collected and processed by our third party payment processor pursuant to the terms and conditions of their privacy policies and terms of use. DBA does not directly obtain, store or process any Billing Information.

4. Other Information

In addition to the Contact Information and Order Information, we may collect or receive the following information:

  • From Your Activity. In an ongoing effort to improve the Site, we automatically collect certain information when you visit the Site. This information consists of IP addresses, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Site you visit, and similar information concerning your use of the Site (“Activity Information”).
  • From Cookies. We also collect Activity Information by using “cookie” technology. Cookies are small packets of data that a website stores on the hard drive of your computer or mobile device to “remember” information about your visit. 5. How We Use and Share Your Information

You authorize us to use the Contact Information, Order Information, and Other Information (collectively, the “Information“) to provide our Site and products to you, solicit your feedback, inform you about our products and services and those of our third-party marketing partners, and to improve the Site.   • Agents, Providers and Related Third Parties. We may engage other companies and individuals to perform certain business-related functions on our behalf. Examples may include providing technical assistance, order fulfillment, customer service, repair, installation or maintenance services, market research, billing and debt collecting services, insurance services, and marketing assistance. In addition, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any DBA marketing email. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases.

7. How We Protect Your Information

DBA takes commercially reasonable security measures to protect your Information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in processing and the nature of such data, and in compliance with applicable laws and regulations.  You should keep in mind, however, that no Internet transmission is 100% secure or error-free.  In particular, e-mail sent to or from the Site may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail or other electronic means.

8. Links to Third-Party Sites

The Site may, from time to time, contain links to external websites. DBA encourages you to review the privacy and security policies of any externally linked websites that may be accessed through the Site.  DBA assumes no responsibility or liability for the information collection and disclosure practices of any external websites that a user can access through the Site.  Please check the privacy policies of these external websites before you submit any personal information to them.

9. Important Notice to All Non-U.S. Residents

Our servers are located in Australia. Please be aware that your Information, including your personal information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside Australia and choose to use Site, you do so at your own risk.

10. California Privacy Rights

Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the preceding calendar year, including the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. 11. DO NOT TRACK

DBA does not monitor, recognize or honor any opt-out or do not track mechanisms including general web browser, “Do Not Track” settings and/or signals.

12. Nevada Privacy Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties. You can exercise this right by contacting us at privacy@dba.com.au with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note, however, that we do not sell personal data.

13. About Children

DBA does not knowingly collect or receive personal information from children under the age of 18 through the Site.  If you are under the age of 18, please do not provide any personal information through the Site. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Privacy Policy by instructing their children to never provide any personal information on the Site or any other web site without their permission.  If you have reason to believe that a child under the age of 18 has provided personal information to DBA  through the Site, please contact us at privacy@dba.com.au,   and we will endeavor to delete that information from our databases.

14. Changes to this Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy.  We may change this Privacy Policy from time to time, and will post any changes on the Site as soon as they go into effect.  By visiting the Site, after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes.  Please be aware that, to the extent permitted by applicable law, our use of the information collected is governed by the Privacy Policy in effect at the time we collect the information.
